CVEC Broadband is on the way, upcoming March BOS meeting agenda, and other items

We’re headed out of what seems to be an easy winter and a fast spring in Buckingham, and your Buckingham Board of Supervisors has a busy agenda coming up for our 6 p.m. meeting on Monday, March 9, 2020 in the Peter Francisco Auditorium at the County Administration Complex. I hope you can attend!

Before the 6 p.m. meeting, the Board will meet with VDOT at 5 p.m. to consider amending our Six Year Improvement Plan for state roads. I have many unpaved roads, including Red Road, Avon Road, Hunters Road, Knights View Lane, and others I plan on addressing with VDOT. If you have any road concerns, please contact me.

Items for consideration or action include a presentation to the family of the late Sallie Atkinson Mowbray, a special use permit for a commercial garage and sale of ag-related equipment on Meadow Creek Road, road matters (see above), an update on the fire department’s tractor pull plans for this year, a budget request from Piedmont Senior Resources, consideration of releasing funding for the Buckingham County Rescue Squad, and an update from our Noise Ordinance Committee.

Talking with and learning about our most important asset…our young people

It was great being with the children at the Buckingham Pre-School on Friday, along with those at other schools across the county.

Last Friday, I had the opportunity to tour the Primary and Elementary School, the Middle School and the Pre-School in Buckingham. Learning about the needs and successes of our public schools is so important, especially as we enter the season of the fiscal year 2020-2021 budget.

I am an ardent supporter of our public schools here in rural Virginia, with a focus on being financially prudent and responsible with an emphasis on keeping our taxes low.

CVEC is expanding rural broadband in Buckingham and Central Virginia

In case you missed the big news, Central Virginia Electric Cooperative is expanding broadband internet in Buckingham and many other counties with using a $28 million USDA ReConnect Grant. Buckingham will see the first signs of expansion under this program.

This is great news for all of us here in Buckingham County and for CVEC’s customers and I am proud to support this great effort in getting high speed fiber optic broadband, not only to the Maysville District, but across Buckingham. This infrastructure will surely lead to more businesses locating here, more students able to complete research and do their homework more efficiently, more teleworking, and more growth overall in our county.

We are so grateful to CVEC, the USDA, our county staff, and everyone else who has worked so long and hard for this great milestone!

Progress at Sewer Expansion at Sprouse’s Corner at Routes 15 and 60

Work is progressing very well at Sprouse’s Corner with the expansion and installation of sewer capacity for the four corners at that Route 15 and Route 60 intersection.

This will bring more businesses and industry to this vital intersection in our community and Buckingham.

Before sewer was expanded at the intersection of Routes 20 and 15, there was little to no business and industry. Since sewer was installed there, we have seen Food Lion, Lucky’s, Farmer’s Bank, McDonald’s, and many other small and local businesses open up shop. I am confident the same will happen at Sprouse’s Corner once our project is complete!

Board of Equalization meeting dates, connecting more with broadband, Route 60, CRC work, and more updates

Months ago, it came to my attention that many landowners and homeowners in the Maysville District/District Four were concerned about their “Notice of 2020 Real Estate Assessment Change” from the County Reassessment Office, notably the increases in assessed values.

If you, as a taxpayer and homeowner or landowner, take issue with the assessment increase or decrease — I cannot stress this point enough — it is of the utmost importance for you to follow and understand the process by which you can appeal the assessment value.

The quick and short of it is that your values ARE NOT set in stone yet. Once the reassessment is completed, the values set by the assessors become the values used for taxing, subject to such changes can be made. You may appeal your assessment in writing or through a hearing with the Board of Equalization. The goal is of the assessment to maintain accuracy and consistency and to reflect current real estate market conditions.

According the Code of Virginia, the Board of Supervisors has no legal concern with the reassessment procedure. After the conclusion of the reassessment process, and during the 2020-2021 fiscal year budget cycle process, the Board of Supervisors will exercise its duty to set the tax rates for real estate, personal property, etc. for the fiscal year budget, and the real estate tax rate is contingent on the values set by the assessors.

Working hard for Broadband and high speed internet

Buckingham County has partnered with the Center for Innovative Technology’s Virginia Commonwealth Connect Broadband Team to work toward having more residents connected to high speed internet. This is a step in the right direction and one that I campaigned on and advocated for, toward empowering more residents, school children, and business owners to have the access they need to internet that will allow them to study and research, do business and sell products, and connect with each other.

In addition, Buckingham County has joined forces with the Virginia Local Broadband Network. This initiative is intended to serve as a platform for local broadband leaders to communicate, share strategies, and work with the Governor’s broadband team directly. I thank county staff for their hard work in pursuing these options.

I very much enjoyed meeting with representatives of the St. Thomas Aquinas Seminary during the Buckingham Chamber of Commerce meeting this week.

CRC Project Updates

I am very proud to represent Buckingham County on the Commonwealth Regional Council (CRC) as a voting member of the council and its treasurer. We met Wednesday morning in Farmville to discuss project updates, planning activities, grant applications, and other regional matters.

The CRC provides a variety of technical and program services to member local governments. They include grant application assistance, management services for program implementation, development/update of Comprehensive Plans, transportation planning, and land mapping and Geographic Information System (GIS) services.   

With the CRC’s direct assistance, the Town of Dillwyn is under contract with the Department of Housing and Community Development (DHCD) for an awarded grant for a housing rehabilitation project. The two remaining homes as part of this grant funded project, will be put to bid once all inspections and ownership has been resolved. Also, as part of Dillwyn’s Phase IV Extended/Phase V of its VDOT funded Streetscape Project, once cost estimates have been worked out, the revised work plans and cost estimate will be submitted to VDOT for approval to advertise the project.

Route 60 Closure

I’d like to give a big hand, thank and commend Central Virginia Maintenance and Pipeline Services, Transco Pipeline, VDOT, our local and state law enforcement, and others involved in getting the pipeline that crosses Route 60 at Whispering Creek completed so soon this month. Despite heavy rain, crews worked around the clock, literally 24 hours a day, to get the job done and on time! Many thanks to them for their hard work.

Survey regarding small business spaces

Attention all small business owners, freelancers, entrepreneurs, remote workers, craftspeople, and creatives. Mid-Atlantic Broadband and GoVirginia need community input on proposed innovative office space in Southern Virginia.  Those who take the survey have the option to remain anonymous or to be entered to win a $50 Visa gift card. The survey is available exclusively online at  This study is designed to gauge whether or not there is a need for additional coworking and makerspaces, the spaces’ desired offerings, and also the amount people would be willing to pay as a member or occasional user of such a space.  This region-wide study of market demand for coworking and makerspaces is being conducted by The Institute for Service Research, a full service market research and economic modeling firm with extensive experience in Southern Virginia. The study is part of a larger innovation and entrepreneurship strategy being developed by Mid-Atlantic Broadband Communities Corporation (MBC) and Longwood University supported by funding by GO Virginia Region 3.  MBC and Longwood are urging people who plan to relocate or who currently work or live in the Southern Virginia Tobacco Region to complete the survey. The region includes Buckingham County. 

February 10, 2020 Board Meeting Summary and Updates

We had a long but very productive Board of Supervisors meeting on Monday, Feb. 10, 2020! We heard from many, many people, and took actions to continue to promote business growth and better protect the citizens of our county. Below is a summary of actions we took. If you want more information from the full board agenda, please don’t hesitate to contact me.

It was great chatting recently with our State Delegate, Del. Matt Fariss, regarding issues of local and state importance.
  • I offered the motion, which passed unanimously, to appoint myself, District Three Supervisor Don Matthews, key county staff, Ron Hudgins (representing Kyanite), and businessmen and woman Sandra Moss, Keith Steger, Pete Kapuscinski, and Gary Cline to the newly-appointed Buckingham Business Development Committee. Zoning and Planning Administrator and Community Development Director Nicci Edmondston will serve as chairman of this facility. I am very proud of this initiative that Supervisor Matthews and I have been working on over the past several weeks. As I said Monday night, in Buckingham, though we face challenges like any other rural Virginia locality, we have lots to be excited for, and that is our upcoming review and rewrite of the Comprehensive Plan, which guides our future and details what we want the county to look like; the great potential of the Atlantic Coast Pipeline, especially with regards to the gas tap; and the new position that Nicci Edmondston is filling in terms of her role in growing our economic development.
  • We graciously accepted another $200,000 donation from CAT Action Team to go toward efforts to improve our current Animal Control Facility.
  • Katie Lewis, who lives on Knights View Lane in the subdivision between the high school and middle school off of High School Road, proposed that the county take in the private road into the VDOT State Roadway System. VDOT will review this and report back.
  • My motion to adopt a resolution in honor and memory of the late Sallie Atkinson Mowbray passed unanimously.
  • The board unanimously adopted a motion I offered to allow the Sheriff’s Office to use a small portion of the former Love Landfill off of Andersonville Road for the purposes of a Shooting Range for only law enforcement officers. See details on the proposal on page 69 here. I visited all 20-plus homes that would be closest to the proposed shooting range along Andersonville Road, and an overwhelming majority were supportive of the Shooting Range, but some were concerned about noise. We did not vote on any funding or funding mechanisms, but only to allow permission to use the property (county owned) for this purpose. See below for answers to questions you all who I visited over the weekend posed.

I would like to thank you for the support you are giving to the Sheriff’s Office and the time you’ve taking to speak with the citizens along Andersonville Rd. This email is to address your concerns about the proposed firing range. 

The noise issue will be dampened greatly by the 12’ feet tall berms and the trees surrounding the range. The closest residence to the range is 718 yards away. At that distance, only a faint “pop” will be heard from each round fired. No training at the proposed range will violate the county noise ordinance. Aside from building an indoor shooting range, the design of the range is the best we can do to eliminate as much noise as possible. As for notifying the residents surrounding the range when is in use. The standard operating procedure is to place a red flag and signage indicating “Range In Use” at the front entrance to the landfill on Andersonville Rd.  

All Sheriff’s Deputies are issued a pistol (40 cal.), patrol rifle (223 cal.) and a shotgun (12 Ga). As directed by DCJS, each Deputy most qualify with all three firearms. Firearms qualification will take place 4 times a year that will also include night time qualification. However, specialized firearms training will be conducted as well. This type of training will include training with other Law Enforcement Agencies such as Virginia State Police and Conservation Police as well as Animal Control Officers. Other types of range use will consist of test firing firearms that have been repaired prior to re-issue and required firearms re-qualification once a Deputy has returned to duty after an injury. Also testing of new firearms and ammunition. In the event a new Deputy is hired, that Deputy will have to qualify with all three firearms prior to duty assignment or prior to attending the Police training academy. 

Unless things change in the future, only Law Enforcement and Animal Control Officers will be training on the range and a DCJS certified firearms instructor will be on site during all range use. According to EPA guidelines, no vapor barrier is needed unless we decide to construct a permanent structure that will be inhabited by humans. 

As to lead deposits at the range, the EPA does not consider lead discharged into dirt berms as hazardous waste until the range is no longer in use and the lead is not cleaned up. A lead abatement process needs to be in place in the event the range is shut down for whatever reason. The EPA has addressed this issue in the Best Management Practices guidelines. This abatement can be handled in a few different ways. First, a lead abatement company can be hired to separate the lead from the soil. Once cleaned up the soil will be redeposited on the berms and the lead sold to a recycling center. Average cost for an abatement company is upwards of $30,000 for berms containing at least 1 million rounds of ammunition. At the current staff of the Sheriff’s Office, it would take approximately 20 years before the agency would fire a million rounds into the soil. Second option is to rent a shakerscreener on an 8 to 10 year interval and use county employees as well as county equipment to recover the lead and redeposit the soil. This will  allow for the county to sell the lead to a recycle center. Rental costs for the shaker varies. Third option is to purchase our own shaker and use county equipment and manpower to clean the berms as needed. The cost of a shaker the size we would need is approximately $12,000.

  • The board approved Stephanie Rainey Roach, a realtor and former construction business owner, to serve on the Board of Zoning Appeals, representing the Maysville District. I am proud to have nominated her.
  • The board made additional appointments to our Ad Hoc Noise Ordinance Committee, which include Supervisor Joe Chambers and Supervisor Donnie Bryan, the sheriff, citizen Eddie Slagle, and other county staff. We have heard from you on this subject and are taking action.
  • During discussion on inviting the School Board to a joint meeting at 5 p.m. on March 18, 2020, I noted that I would like school officials, not only to bring budgetary plans and narratives, but also to offer the Board of Supervisors insight into their past and foretasted division enrollment of students, along with efforts for all schools to reach full accreditation. I think these factors are crucial and vital when planning ahead for the future and budgeting. I am very much-pro education and I think public education is the great equalizer, and I want to see the successes of our schools and how they can be aided as well. I look forward to a robust conversation with the school board in March.

Temporary road closure & detour planned due for Colonial Pipeline maintenance

As part of a planned maintenance project, part of Route 60 will be closed in February due to Colonial Pipeline’s scheduled work.

The road closure will be temporary, planned between Monday, Feb. 10 at 7 a.m. through Friday, Feb. 14, 2020 at 5 p.m.

The project will include excavation of pipe of the pipeline, conducting maintenance work required, and restoring the road way and property.

Between these times, VDOT will close Route 60 between Rosney Road and Scotts Bottom Road. If inclement weather delays this project, the project may include Feb. 15 and 16.

During this work, traffic will be diverted using Route 15 to Bell Road, Main Street, and Scotts Bottom Road. Local traffic can still use Route 60 for access, except for the area between Rosney Road and Scotts Bottom Road.

January 2020 Meeting Summary

First, as I was jogging today, it (again) dawned on me how blessed and proud I am to represent you and your families in the Maysville District on the Buckingham Board of Supervisors. I thank God and you all for this opportunity. I hope you know it is truly my honor to be your voice on the board, and to do that successfully, I need to hear from you on what’s important to you and your family. During our meeting on Monday, I expressed my desire, while representing and working hard for you and District Four on the board, my commitment in working with my fellow board members as a team. I seek to learn from my fellow supervisors and to represent your values and interests in the Maysville District.

Board Actions from January 13, 2020

  • The board appointed District Five Supervisor Harry Bryant as Chairman and District Three Supervisor Don Matthews as Vice-Chairman. The board also adopted bylaws (operating rules).
  • The board a public hearing planned regarding a zoning text amendment (regarding private parks and playgrounds).
  • During VDOT matters, I brought up the issues, among others, you have told me about Red Road and the need to complete the surface treatment on the Route 60 end. VDOT also addressed a petition presented by Jessy Warner, signed by many residents and neighbors on Route 15 near Sprouse’s Corner, about extending the 45 MPH speed limit from just south of Sprouse’s Corner to Andersonville Road, which I support. VDOT will perform a traffic study and return in about two months with results.
  • Robinson, Farmer & Cox reported on their financial audit regarding the Fiscal Year 2019 Audit, which was returned with an unmodified or “clean” audit.
  • There were many committee appointments, and I am proud to say that I will represent District 4 on the Utilities (Sewer and Water) Committee, and will represent Buckingham on the Commonwealth Regional Council (where today I was appointed Treasurer) and on the Crossroads Community Services Board (CSB).
  • I also voted in favor of creating two new committees: One in which to create to form a committee to draw new businesses and industry into the county and better market our county, which I offered the motion for, and another to address recycling needs across the county. Expanded recycling is one issue that many of you brought up during the campaign, and I am proud to support this.
  • The Board voted in favor of a request for an easement from the engineer who is designing the utilities for the new hotel on Wingo Road off of Route 15 that they needed for the purpose of a sewer lateral. This project will invest more than $6 million into our county and bring several jobs with it.
  • I also voted in favor of resolutions to memorialize the late Brady Jones and to honor Dan Senger.
  • Emergency Management Coordinator Cody Davis, along with District One Supervisor Bobby Jones, offered a report from the Amish Safety Committee. Their report was extensive, and their work has included proposed actions, such as more signage, vehicle reminder stickers, the Amish considering additional white or amber strobes on rear of buggies, a comprehensive “Share the Road” educational campaign, distributions of literature with county decal purchases, partnering with the school division to include additional curriculum in driver’s education courses, and holding a “Safety Day” in conjunction with Historic Buckingham’s Mayfest in May of this year. I expressed my support for these innovative measures in that distracted driving is the root of many of these issues, which not only include horses and buggies, but joggers, tractors, walkers, bicyclists, and other slow moving vehicles. The Amish community is going to be polled for these and various ideas to improve their safety and ours.
  • I expressed concern, which was shared by the board, regarding bills being considered by the Virginia General Assembly that would result in less control by localities, especially rural counties, amid the growth and expansion of solar farms in our county and region. I will address that in another post.

Board Meeting Summary — December 2019

I’m pleased to offer you a strictly factual summary of some of the high points of the Monday, Dec. 10, 2019 Buckingham Board of Supervisors’ meeting last night. If you’d like my opinion on any of these agenda items, of if you want more information on any agenda item I summarized or didn’t, please don’t hesitate to email, call, or text me.   • Consideration of a Resolution of the Buckingham County Board of Supervisors In Support of Second Amendment Rights — This resolution was unanimously adopted.
  • Public Comments — Most spoke in favor of the Resolution Regarding Supporting the Second Amendment, while a few spoke in favor of more gun control and concern regarding gun violence.
  • Public Hearing:  Consideration of Lessening the Board of Equalization’s Setting Time for Hearing — This hearing was held with no speakers. The board took no action on lessening the Board of Equalization’s setting as many landowners have seen increases in their reassessment statements.
  •  Public Hearing for the Trans Tech Alliance Ordinance — Following the public hearing, the board adopted the bylaws of the alliance, also known as Virginia Growth Alliance (VGA), and also decided to give its 6-month notice to leave the organization.
  •  Introduction of Zoning Application 19-ZTASUP268, Allen Perkins to Add Privately Owned Parks and Playgrounds to the list of Special Use Permits in the Agricultural 1 Zoning District — The board set a public hearing in January during its regular meeting on this matter.
  • Rescue Squad Committee Recommendation to Release $50,000.00 of the $195,000.00 Appropriation to the Buckingham County Rescue Squad — The board agreed to this. This totals $100,000 for this fiscal year from the county from the $195,000.

Information Regarding the Reassessment

It has come to my attention that many landowners and homeowners in the Maysville District are concerned about their "Notice of 2020 Real Estate Assessment Change" from the County Reassessment Office, notably the increases in assessed values.

If you, as a taxpayer and homeowner or landowner, take issue with the assessment increase or decrease -- <strong>I cannot stress this point enough -- it is of the utmost importance for you to follow and understand the process by which you can appeal the assessment value. 

The quick and short of it is that your values ARE NOT set in stone yet. Once the reassessment is completed, the values set by the assessors become the values used for taxing, subject to such changes can be made. You may appeal your assessment in writing or through a hearing with an assessor. If you make a written appeal, you do not need to attend a hearing. The goal is of the assessment to maintain accuracy and consistency and to reflect current real estate market conditions. 

If you are not satisfied with the outcome of the first appeal, the Board of Equalization will hear your next appeal. The dates for these hearings will be advertised online at, which will be scheduled in early 2020. 

According the Code of Virginia, the Board of Supervisors has no legal concern with the reassessment procedure. After the conclusion of the reassessment process, and during the 2020-2021 fiscal year budget cycle process, the Board of Supervisors will exercise its duty to set the tax rates for real estate, personal property, etc. for the fiscal year budget, and the real estate tax rate is contingent on the values set by the assessors.

 VIRGINIA DEPARTMENT OF TAXATION Guide to Understanding Real Estate Assessment Values Property Tax Section May 2015 [A brief overview of the real estate valuation processes typically used in local real estate assessment offices.] ~ 2 ~ 

INTRODUCTION Often misunderstood, this Guide has been developed to help Virginia real property owners and taxpayers better understand the real estate valuation processes typically used in local real estate assessment offices. In days past the Commonwealth relied upon its citizens to estimate real estate assessment values. This system worked well enough when real estate markets were relatively static and where properties were generally similar in nature. Recent decades have witnessed rapid changes in real estate markets, both in terms of activity and complexity. Additionally, the growth of local government and a rise in local funding needs have focused the public's attention on property tax to an extent heretofore unknown. The timehonored system of assessments made by lay citizens has proved to be unworkable and very likely to produce inaccurate and inequitable assessments. In order to satisfy Virginia's constitutional mandate requiring fair market value assessments, localities have found it beneficial to employ professional appraisers/assessors either to assume legal responsibility for conducting reassessments or to act as technical assistants. Assessors and their appraisal staff are expected to be knowledgeable in assessment methodology and process, to be knowledgeable of applicable Virginia and local laws, to approach their duties with an open mind, and exercise impartial judgment in the development of assessment values. Since 1976, the Department of Taxation has offered basic and advanced courses for improving appraisal knowledge and job skills. ~ 3 ~ UNDERSTANDING REAL ESTATE ASSESSMENTS A proper understanding and application of the term assessment is fundamental to understanding real estate assessments. Defined in the Virginia Tax Administrative Code, Code Section 23VAC10-500-580: "Assessment" means a determination as to the proper rate of tax, the measure to which the tax rate is applied, and ultimately the amount of tax, including additional or omitted tax, that is due. An assessment shall include a written assessment made pursuant to notice by the assessing official or a self-assessment made by a taxpayer upon the filing of a return. Its use can apply to an individual property, or to all properties in a grouping. The definition encompasses several components: The rate at which property will be taxed (the tax rate) The measure, or value of property to be taxed (the assessment or assessed value) The total amount of the tax on property that will be billed (the tax levy) Some may refer to only one of these components when using the term, which can lead to confusion. To avoid any confusion, one must be aware of and consider all three components of the definition during assessment discussions. However, for the purpose of this Guide, the term “assessment” is synonymous with “assessment value” or “assessed value”, being those values that best assure a total real estate tax levy that is equitably borne by the property owners of a locality. Constitutional and Statutory Mandate The Constitution of Virginia, in Article X, mandates that all property shall be taxed, and further stipulates that all taxes shall be uniform upon the same class of subjects within the territorial limits of the authority levying the tax. Other provisions of Article X require that all assessments of real estate shall be at fair market value with the exception of those assessments of certain real estate devoted to agricultural, horticultural, forest and open space uses, which may be granted preferential assessments. In addition, Article X segregates real estate as subject to local taxation only, with the provision that real estate shall be assessed in such manner and at such times as the General Assembly may prescribe by general law. The statutes controlling real estate assessments and reassessments are located in Chapter 32, of Title 58.1, of the Code of Virginia. Generally, these statutes are numerous and beyond the scope of this discussion. However, an understanding of some statutes may be helpful. Virginia law requires periodic reassessments of real estate in every taxing jurisdiction. Some jurisdictions reassess annually, however, by law six years is the most time allowed between reassessments for counties; four years for cities. Population thresholds may require more  ~ 4 ~ frequent reassessments, and the local governing body may determine the need to reassess more frequently. Local governing bodies are not permitted to reap revenue windfalls due to an increase in assessed values (see § 58.1-3321, Code of Virginia). Subsequent to a reassessment, the local governing body must reduce the levy by lowering the tax rate as to produce no more than 101 percent of the revenue generated in the previous year. If a higher rate is necessary, the governing body must advertise the increase and conduct a public hearing on the matter. This safeguard has been put into law since the responsibility for increasing local government revenues should be properly borne by the governing body and not by the assessing officer. This limitation applies only to total revenues; the actual tax bill of an individual property owner may increase at a greater rate. Following general reassessment, the tax rate approved by the local governing body is applied to the new values. The assessments are not responsible for increases or decreases in the real estate tax levy. The local governing body has the sole responsibility for determining the real estate tax levy by setting the tax rate in accordance with the budgetary needs of the locality. The assessed values established during a general reassessment are applicable until another general reassessment occurs. Examples of permitted changes are those caused by factual or clerical errors, rezoning, subdivision of land, and construction or destruction of buildings. New land parcels or new buildings created between reassessment cycles shall be assessed uniformly with the assessments made on similar property during the most recent general reassessment. The Code of Virginia requires that the tax is levied at 100% of appraised value. Prior to 1977, the tax levy for most localities was based on a fraction of the appraised value. The fraction varied from one locality to the next and from one general reassessment to the next. This system masked inequalities and made it difficult to compute the true tax rate or to compare the assessed value for one property with the assessed value of a similar property. In 1975, the General Assembly amended Section 58.1-3201 of the Code of Virginia to require that local tax levies effective in 1977 or after is based on 100% of appraised value. In accordance with Virginia law, real estate reassessments are overseen by the Commissioner of the Revenue, by a Board of Assessors, or by a Professional Assessor, who is someone appointed by the local governing body, and who is either an employee meeting the qualifications prescribed by the Department of Taxation or an independent contractor holding valid certification issued by the Department. That person or body is recognized, for the purposes of this Guide, as the Assessing Officer. Fiscal Well Being of the Locality A significant portion of local government revenue is derived from real estate assessments. With local support, tax rates can be adjusted to meet changing revenue needs. The fiscal health, the  ~ 5 ~ services provided, and the level of confidence in local government all rely in part on accurate real estate assessment valuations. Improper assessment practices can result in inequitable assessment values and/or outdated values. The ability of local governments to utilize bond financing is limited to a percent of debt to total assessed real estate value. In addition, bond ratings may be based on the total assessed value of the real estate of the locality. Real estate values typically reflect public expenditures for services and capital improvements. As a measure of the wealth of a locality, it is possible for a higher total assessed value to result in a higher bond rating and a lower interest rate. Real estate values play an important role in the distribution of state aid to elementary and secondary education. This aid is distributed by a formula that factors both need and the local tax effort to ensure that all localities are able to finance the major costs of the Standard of Quality in the State. The estimated true value of all taxable real estate in each locality, the 100% fair market value estimate, is a key component in the formula for aid distribution. It should be recognized that the fiscal well being of a locality is only truly maximized when assessed values are equitable and represent fair market values. Fair Market Value Code of Virginia, § 58.1-3280. Assessment of values Every assessor or appraiser so designated under this chapter shall, as soon as practicable after being so designated, proceed to ascertain and assess the fair market value of all lands and lots assessable by them, with the improvements and buildings thereon. They shall make a physical examination thereof if required by the taxpayer and in all other cases where they deem it advisable. Fair Market Value is the term used in the Constitution of Virginia, the Code of Virginia, and Virginia courts when addressing the assessment value of property. Virginia does not have a statutory definition for fair market value. Instead, having evolved from its application in a series of court cases over a number of years, fair market value is generally accepted to mean: “The fair market value of property is the price which it will bring when it is offered for sale by one who desires, but is not obliged, to sell it, and bought by one who is under no necessity of having it”, (See Tuckahoe Women's Club v. City of Richmond, 119 Va. 734, 101 S.E.2 d571 (1958)) The Assessing Officer develops estimates of fair market value that are the basis for assessment equalization. Though not defined in Virginia law, fair market value is commonly viewed by the  ~ 6 ~ assessment community as the equitable market value of property, that is, Equity plus Market Value equals Fair Market Value. Price, Cost, and Value The concepts of price, cost, and value should not be confused. Price is the amount actually paid for a property in a particular transaction. Price is a historical fact; it is not a prospective concept. The price paid is the amount a particular buyer has agreed to pay and a particular seller has agreed to accept under the conditions surrounding their transaction. Cost refers to production, not exchange. It is the expenditure required to produce property, such as the cost of constructing a building. Cost can be a historical amount, a current amount, or a prospective amount. The Dictionary of Real Estate Appraisal defines value in a general sense as "the monetary worth of a property, good, or service to buyers and sellers at a given time." In contrast to price, the concept of value has a prospective aspect, in that the value at a given time reflects an anticipation of benefits to be received in the future. Market Value vs. Market Price Market Value is an appraisal term that applies to a hypothetical concept, not an established fact. Definitions of market value are recognized by different organizations, and can vary somewhat. Most definitions include components for an estimated probable selling price, at a particular point in time; assume a sale that occurs between informed parties acting for their own best interests, and without duress. Other definition components may include: Allowing adequate time to sell the property; Proper exposure to the open market; An “arm’s-length” transaction, i.e., one not involving love and affection or other nonmonetary consideration; A sale transacted on typical terms with regard to financing and conditions of sale; A value that reflects the property’s highest and best use Market Price, on the other hand, is a fact. It is the actual number of dollars for which a property has sold. The two terms do not mean nor do they necessarily represent the same thing. Because a property sold at a particular price, does not mean that the sale price is its market value. The data from a number of qualified sales are analyzed, together with other market value indicators, for an estimate of market value, which may be more or less than a recent market price. ~ 7 ~ The Assessing Officer is not expected to predict the actual selling price of specific properties. Market value is the estimated probable selling price of a property at a particular point in time. Simply stated, it can be viewed as the point around which market prices will tend to cluster. Equalization and the Assessment Process The primary goal of a reassessment is to establish property values that best assure a real estate tax levy that is equitably borne by the property owners of the locality. In doing so, the Assessing Officer must strive for an overall assessment level of 100% of fair market value. For unique properties, an individual appraisal of a property may be performed. However, fair and equitable assessments require utilizing accepted mass appraisal standards and techniques that are applied uniformly, and are in accordance with state statutes and local ordinances. The Commonwealth of Virginia recognizes and accepts procedures, rules, and standards as prescribed by nationally recognized professional appraisal organizations such as the International Association of Assessing Officers (IAAO). Complete and Accurate Records The assessment process begins with and relies on a complete and accurate file of all properties within a jurisdiction, a Property Record File. This means that records have been created for each parcel. Ideally, the records contain current, complete, and accurate descriptive information about the land and the improvements to each parcel. This includes, among other things, data concerning ownership, parcel location, physical characteristics, and use. If the property is improved, the Assessing Officer must record all improvements; ascertain age, size, condition, type, quality of construction, and other relevant characteristics. The Assessing Officer must work with the best available data at any given point in the assessment cycle. Though striving for the ideal, it must be understood that in many localities there is rarely the opportunity to inspect the interiors of all properties being valued during the assessment cycle, that data collected is subject to change without notice, and that file data can soon become outdated. Mass Appraisal, Classification and Stratification There are differences between the appraisal of a single property and mass appraisal used for real estate assessments. When estimating value, the fee appraiser is typically limiting his analysis and conclusion to a single property, or single type of property. Most property owners experience this process when a fee or single property appraisal is made for their property, often in conjunction with financing or refinancing. When estimating the value of all properties within the jurisdictional boundaries of a locality, the Assessing Officer develops value estimates for groups of similar properties utilizing mass  ~ 8 ~ appraisal techniques, which typically include the collection and statistical analysis of large amounts of data. One technique employed is the classification and stratification of the properties. In accordance with the Code of Virginia (§ 58.1-208) and for assessment purposes, all real property is classified. The classification identifies a group of similar properties as a property type. The Department of Taxation has established seven broad classes of real estate for use by Assessing Officers in Virginia. Department of Taxation Property Class Codes Class Class Name 01 Single-Family Urban 02 Single-Family Suburban 03 Multi-Family Residential 04 Commercial and Industrial 05 Agricultural or Undeveloped - 20 to 100 acres 06 Agricultural or Undeveloped - over 100 acres 07 Tax Exempt Assessing Officers may subdivide the seven classes, as deemed necessary, for more specific and accurate appraisal. Once classified, the properties within a classification are then stratified. A class of properties may be stratified according to its characteristics, and the relationship of those characteristics to market value. A property may be classified as 01 Single-Family Urban. It is recognized that not all 01 Single-Family Urban properties will have the same characteristics. The Assessing Officer may use a Construction ranking or grade, for example, Poor through Excellent, A through E, or 1 through 5, to identify different strata within a classification, and then will relate each stratum to a value level. With all properties in the jurisdiction properly classified, and stratified, the Assessing Officer will collect and analyze market value indicators. Market Value Indicators Various forms of data that will provide market value indicators must be assembled in order to develop reliable estimates of value. This includes data pertaining to local economic conditions, planning and zoning regulations, and neighborhood boundaries. Additionally, current construction cost data, income and expense data for rental properties, and recent qualified real  ~ 9 ~ estate sales must also be compiled. Sources of this information include public records, real estate and construction professionals, property owners and physical inspections. With the collection of market value indicators, the Assessing Officer can begin the process of analysis, applying sound judgment, together with the best practices of the assessment field in order to develop reliable estimates of market value. Approaches to Value, Analysis, Modeling, and Model Calibration The appraisal profession generally relies on three traditional approaches to an estimate of value. These are the cost, sales comparison, and income capitalization approaches. All are based on accepted economic principles. Cost Approach: most suitable for new, unique, or special purpose properties, and is the cost to construct a reproduction or suitable replacement of the improvements, less the accrued depreciation, added to the value of the land to provide a total estimated value for the property. The applicable economic principle is substitution; i.e., a prudent purchaser would not pay more for a property than the cost of building a reproduction, replacement or suitable substitute for it. Sales Comparison Approach: most suitable when there are sufficient sales. The sale prices are analyzed, and adjustments are made to reflect any differences between the properties sold and the property being valued. Again, the principle is that of substitution, i.e., a prudent buyer would not pay more for a property than the price to purchase a similar property. Income Capitalization Approach: is most suitable for commercial and multifamily income producing properties. Rental income and operating expenses are analyzed and calculations made for an estimate of what a property can earn for its owner. The net income to the owner is then capitalized into an estimate of value. The economic principle governing this concept is anticipation, that is, value equals the present worth of the future net benefits of ownership. In the appraisal process, one approach may be more applicable to one property classification than to another. When reconciling the various approaches an appraiser may select, or accord more weight to the approach that is most applicable to the property type being valued. Assessing Officers utilize verified market value indicators, statistical analysis, traditional approaches to value, and property classifications and characteristics to construct Valuation Models for various property classes and stratum. Although Models can vary and are generally more complex, the example below illustrates a stratification level, and the Base Value for those properties sharing the characteristics identified. Valuation models provide a uniform basis for developing equitable assessment values, and can be calibrated to reflect changing market conditions. Modeling also allows for adjustments to be made for differences among the various properties within property classification strata. In our  ~ 10 ~ example, which would be developed from an analysis of market value indicators, a base Model value of $100 per square foot of gross building area is estimated. Characteristics such as a garage or extra bathrooms would likely result in added value or positive adjustments to the base value. Characteristics such as fewer bedrooms or an irregular shaped lot may result in reduced value or negative adjustments to the base value. Some characteristics, such as a significant size or age variation, may result in a positive or negative adjustment. With the application of the adjustments to the base value, the assessment values for individual properties can be estimated. What is important is  ~ 11 ~ that properties were properly described, classified, stratified, and the values were developed in a uniform and equitable manner. In recent years, more and more localities are relying on computerized assessment systems. Property data is updated, stored, statistical computations are performed, and calibrations are made to Valuation Models based on current market information. When managed properly by knowledgeable appraisal professionals, the computer-based assessment system will perform calculations that result in uniform and equitable fair market value assessments. Indexing or Trending There may be times when data is not available in sufficient quantity or quality for some property groups, be it a geographical area or a property type. This can occur in localities having short reassessment cycles, a variety of property types, and/or a number of unique properties. In order to establish overall equity in the locality, Assessing Officers may rely on indexing, or trending values based on changes in broader segments of the local market. The Assessing Officer will attempt to relate value changes in property groups similar to the group lacking sufficient data. For example, the Assessing Officer finds that there is insufficient data to develop new values for Property Group-A. However, for Property Group-B, which has similar characteristics to GroupA and sufficient data for traditional valuation methods, it is determined that values have dropped 3%. In the absence of other reliable data, the Assessing Officer would have a supportable basis for value adjustments to Property Group-A based on overall changes in the similar Property Group-B. Consistent, Supportable and Explainable There are various acceptable techniques for developing assessment values. Practice of the appraisal profession with any degree of confidence requires experience and study (which the appraiser should continue throughout his career). The indispensable ingredient is good, impartial judgment. The goal of the Assessing Officer is the unbiased development of fair and equitable assessment values. What is required of any Assessing Officer is that assessment values be consistent, supportable, explainable, and of course, reliable. Assistance with particular valuation questions is available from the local professional staff or from the Department of Taxation Property Tax Section.
